These Terms of Use ("Terms") are a legal agreement between you and ("we", "us", "our") about your use of the PoolMaster mobile app, the website and related services (together, the "Service"). By creating an account or using the Service, you agree to these Terms and to our Privacy Policy. If you're using the Service for a business, you agree on behalf of that business and confirm you have the authority to do so. If you don't agree, don't use the Service.
1. Eligibility and accounts
You must be at least 18 years old and able to form a binding contract. You agree to give accurate account information and keep it up to date, to keep your password confidential, and to tell us right away about any unauthorized use. You're responsible for everything that happens under your account.
2. Business owners and employees
A business owner may invite employees to join their business in the Service. The owner is responsible for the employees they add, for what those employees do in the Service, and for removing access when it's no longer appropriate. Employees can use the features included in their business's plan, and their access ends when the owner removes them or the owner's account closes.
3. License
As long as you follow these Terms, we grant you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to install and use the app on devices you own or control, and to use the Service for your internal business purposes.
4. Acceptable use
You agree not to:
- copy, modify, distribute, sell, rent or lease any part of the Service;
- reverse engineer or try to extract the source code, except where the law expressly allows it;
- access, or try to access, another user's account or data, or get around any security or plan limit;
- use the Service for anything unlawful, fraudulent or harmful, or to store content you don't have the right to store;
- interfere with or disrupt the Service, including by sending malware or excessive automated requests;
- use the Service to build a competing product.
5. Plans, billing and renewal
- Plans. We offer a Free plan and paid plans (currently Starter and Pro). Each plan's features and limits are described on our pricing page.
- Payment. Paid plans are bought on our website and billed monthly, in advance, to the payment method you provide, through our payment processor Stripe. You authorize us and Stripe to charge that payment method for all fees due. Prices don't include taxes unless stated; you're responsible for any applicable taxes.
- Automatic renewal. Your subscription renews automatically each month at the then-current price until you cancel. If we change the price, we'll notify you before it applies to your next renewal, and you can cancel before then.
- Cancellation. You can cancel any time from your account → Manage subscription. Cancellation takes effect at the end of the current billing period; your plan stays active until then and then changes to Free.
- Plan changes. When you change plans, any proration, charge or credit is shown before you confirm.
- Refunds. Except where required by law, payments are non-refundable, and we don't give refunds or credits for partial months or unused features.
- Failed payments. If a payment fails, we may retry it. If it still can't be collected, your plan may be changed to Free.
- Plan limits. If your data goes over your plan's limits, for example after a downgrade, the extra items become read-only until you remove some or upgrade. We don't delete your data because of a downgrade.
- Team coverage. A business owner's plan covers the employees paired with that business.
6. Your content
You keep all rights to the information you put into the Service ("Your Content"). You give us a limited license to host, store, copy, transmit and display Your Content only as needed to provide and support the Service. You confirm that you have the right to provide Your Content, including any personal information about your customers, and that doing so doesn't break any law or anyone's rights. You're responsible for keeping your own backups of important data.
7. Feedback
If you send us suggestions or feedback, we may use them without any obligation to you.
8. Our intellectual property
The Service, including its software, design, text, graphics and the PoolMaster name and logo, belongs to us or our licensors and is protected by intellectual property laws. Apart from the license in Section 3, these Terms don't give you any rights in it.
9. Third-party services
The Service relies on third-party services such as app stores, payment processing, hosting and maps. Your use of those services may be subject to their own terms, and we're not responsible for them.
10. Changes to the Service
We may add, change or remove features. If we remove a material feature of a paid plan during a billing period you've already paid for, we'll give you a fair remedy, such as a prorated credit.
11. Suspension and termination
You may stop using the Service and delete your account at any time. We may suspend or end your access if you materially break these Terms, if required by law, or if your use creates a security or legal risk. Where reasonable, we'll notify you first and give you a chance to export your data. Sections 6–8 and 12–17 survive termination.
12. Disclaimer of warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE". TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT. WE DON'T WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE OR SECURE, OR THAT DATA WILL NEVER BE LOST. The Service is a scheduling and record-keeping tool. It doesn't give professional advice about pool chemistry, equipment or safety, and you remain responsible for the work you perform.
13. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW: (A) WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, DATA OR GOODWILL, ARISING OUT OF OR RELATED TO THE SERVICE, EVEN IF WE WERE ADVISED OF THE POSSIBILITY; AND (B) OUR TOTAL LIABILITY FOR ALL CLAIMS RELATED TO THE SERVICE WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR US $50. Some jurisdictions don't allow some of these limitations, so they may not all apply to you.
14. Indemnification
You agree to defend, indemnify and hold harmless and its officers, employees and agents from any claims, damages, losses and expenses, including reasonable attorneys' fees, arising from Your Content, your use of the Service, your employees' use of the Service under your business, or your breach of these Terms or of any law.
15. Governing law and disputes
These Terms are governed by the laws of , without regard to its conflict-of-laws rules. Before filing a claim, you agree to contact us at and try to resolve the dispute informally for at least 30 days. Any dispute that isn't resolved will be heard exclusively in the state, territorial or federal courts located in , and both parties consent to the jurisdiction of those courts. Either party may bring a qualifying claim in small-claims court.
16. Changes to these Terms
We may update these Terms from time to time. We'll change the effective date above, and if the changes are material we'll notify you in the app or by email before they take effect. If you keep using the Service after the changes take effect, you accept the updated Terms.
17. General
These Terms and the Privacy Policy are the entire agreement between you and us about the Service. If any provision is found unenforceable, the rest stays in effect. Our not enforcing a provision isn't a waiver of it. You may not assign these Terms without our consent; we may assign them as part of a merger, acquisition or sale of assets. Neither party is responsible for delays caused by events beyond its reasonable control.

1. Requisitos y cuentas
Debes tener al menos 18 años y capacidad para celebrar un contrato vinculante. Aceptas dar información de cuenta correcta y mantenerla al día, mantener tu contraseña en secreto y avisarnos de inmediato sobre cualquier uso no autorizado. Eres responsable de todo lo que ocurra en tu cuenta.
2. Dueños de negocio y empleados
El dueño de un negocio puede invitar a empleados a unirse a su negocio en el Servicio. El dueño es responsable de los empleados que agrega, de lo que esos empleados hagan en el Servicio y de quitarles el acceso cuando ya no corresponda. Los empleados pueden usar las funciones incluidas en el plan de su negocio, y su acceso termina cuando el dueño los quita o cuando se cierra la cuenta del dueño.
3. Licencia
Siempre que cumplas estos Términos, te otorgamos una licencia limitada, no exclusiva, intransferible, no sublicenciable y revocable para instalar y usar la app en dispositivos que te pertenecen o que controlas, y para usar el Servicio para los fines internos de tu negocio.
4. Uso aceptable
Aceptas no:
- copiar, modificar, distribuir, vender, alquilar ni arrendar ninguna parte del Servicio;
- aplicar ingeniería inversa ni intentar extraer el código fuente, salvo cuando la ley lo permita expresamente;
- acceder, o intentar acceder, a la cuenta o los datos de otro usuario, ni evadir ninguna medida de seguridad o límite de plan;
- usar el Servicio para algo ilegal, fraudulento o dañino, ni para guardar contenido que no tienes derecho a guardar;
- interferir con el Servicio o interrumpirlo, incluido el envío de malware o de solicitudes automatizadas excesivas;
- usar el Servicio para crear un producto competidor.
5. Planes, facturación y renovación
- Planes. Ofrecemos un plan Gratis y planes de pago (actualmente Starter y Pro). Las funciones y los límites de cada plan se describen en nuestra página de precios.
- Pago. Los planes de pago se compran en nuestro sitio web y se facturan mensualmente, por adelantado, al método de pago que nos des, a través de nuestro procesador de pagos Stripe. Nos autorizas a nosotros y a Stripe a cobrar a ese método de pago todos los cargos que correspondan. Los precios no incluyen impuestos salvo que se indique; eres responsable de los impuestos que apliquen.
- Renovación automática. Tu suscripción se renueva automáticamente cada mes al precio vigente en ese momento hasta que la canceles. Si cambiamos el precio, te avisaremos antes de que aplique a tu próxima renovación, y podrás cancelar antes.
- Cancelación. Puedes cancelar en cualquier momento desde tu cuenta → Administrar suscripción. La cancelación entra en vigor al final del período de facturación actual; tu plan sigue activo hasta entonces y luego cambia a Gratis.
- Cambios de plan. Cuando cambias de plan, cualquier prorrateo, cargo o crédito se muestra antes de que confirmes.
- Reembolsos. Salvo cuando la ley lo exija, los pagos no son reembolsables, y no damos reembolsos ni créditos por meses parciales ni por funciones sin usar.
- Pagos fallidos. Si un pago falla, podemos volver a intentarlo. Si aun así no se puede cobrar, tu plan puede cambiar a Gratis.
- Límites del plan. Si tus datos superan los límites de tu plan, por ejemplo después de bajar de plan, los elementos que sobran quedan de solo lectura hasta que elimines algunos o mejores tu plan. No eliminamos tus datos por bajar de plan.
- Cobertura del equipo. El plan del dueño de un negocio cubre a los empleados vinculados con ese negocio.
6. Tu contenido
Conservas todos los derechos sobre la información que pones en el Servicio ("Tu contenido"). Nos das una licencia limitada para alojar, guardar, copiar, transmitir y mostrar Tu contenido solo en la medida necesaria para prestar el Servicio y darle soporte. Confirmas que tienes derecho a proporcionar Tu contenido, incluida cualquier información personal sobre tus clientes, y que hacerlo no viola ninguna ley ni los derechos de nadie. Eres responsable de guardar tus propios respaldos de los datos importantes.

Si nos envías sugerencias o comentarios, podemos usarlos sin ninguna obligación contigo.
8. Nuestra propiedad intelectual
El Servicio, incluidos su software, diseño, textos, gráficos y el nombre y el logo de PoolMaster, nos pertenece a nosotros o a nuestros licenciantes y está protegido por las leyes de propiedad intelectual. Aparte de la licencia de la Sección 3, estos Términos no te dan ningún derecho sobre él.
9. Servicios de terceros
El Servicio depende de servicios de terceros, como tiendas de apps, procesamiento de pagos, hosting y mapas. Tu uso de esos servicios puede estar sujeto a sus propios términos, y no somos responsables de ellos.
10. Cambios al Servicio
Podemos agregar, cambiar o quitar funciones. Si quitamos una función importante de un plan de pago durante un período de facturación que ya pagaste, te daremos una solución justa, como un crédito prorrateado.
11. Suspensión y terminación
Puedes dejar de usar el Servicio y eliminar tu cuenta en cualquier momento. Podemos suspender o terminar tu acceso si incumples de forma importante estos Términos, si la ley lo exige o si tu uso crea un riesgo de seguridad o legal. Cuando sea razonable, te avisaremos primero y te daremos la oportunidad de exportar tus datos. Las Secciones 6 a 8 y 12 a 17 siguen vigentes después de la terminación.
12. Exclusión de garantías
EL SERVICIO SE OFRECE "TAL CUAL" Y "SEGÚN DISPONIBILIDAD". EN LA MEDIDA MÁXIMA QUE PERMITA LA LEY, RENUNCIAMOS A TODA GARANTÍA, EXPRESA O IMPLÍCITA, INCLUIDAS LAS GARANTÍAS DE COMERCIABILIDAD, IDONEIDAD PARA UN FIN DETERMINADO, TITULARIDAD Y NO INFRACCIÓN. NO GARANTIZAMOS QUE EL SERVICIO FUNCIONE SIN INTERRUPCIONES, SIN ERRORES O DE FORMA SEGURA, NI QUE NUNCA SE PIERDAN DATOS. El Servicio es una herramienta de programación y registro. No ofrece asesoría profesional sobre química de piscinas, equipo o seguridad, y sigues siendo responsable del trabajo que realizas.
13. Limitación de responsabilidad
EN LA MEDIDA MÁXIMA QUE PERMITA LA LEY: (A) NO SEREMOS RESPONSABLES DE NINGÚN DAÑO INDIRECTO, INCIDENTAL, ESPECIAL, CONSECUENTE, EJEMPLAR O PUNITIVO, NI DE LA PÉRDIDA DE GANANCIAS, INGRESOS, DATOS O REPUTACIÓN, QUE SURJA DEL SERVICIO O ESTÉ RELACIONADO CON ÉL, AUNQUE SE NOS HAYA ADVERTIDO DE ESA POSIBILIDAD; Y (B) NUESTRA RESPONSABILIDAD TOTAL POR TODOS LOS RECLAMOS RELACIONADOS CON EL SERVICIO NO SUPERARÁ LA CANTIDAD MAYOR ENTRE LO QUE NOS PAGASTE EN LOS 12 MESES ANTERIORES AL HECHO QUE DIO LUGAR AL RECLAMO Y US $50. Algunas jurisdicciones no permiten algunas de estas limitaciones, así que puede que no todas apliquen en tu caso.
14. Indemnización

16. Cambios a estos Términos
Podemos actualizar estos Términos de vez en cuando. Cambiaremos la fecha de vigencia de arriba y, si los cambios son importantes, te avisaremos en la app o por correo antes de que entren en vigor. Si sigues usando el Servicio después de que los cambios entren en vigor, aceptas los Términos actualizados.
17. Disposiciones generales
Estos Términos y la Política de privacidad son el acuerdo completo entre tú y nosotros sobre el Servicio. Si alguna disposición se considera inaplicable, el resto sigue vigente. Que no hagamos cumplir una disposición no significa que renunciemos a ella. No puedes ceder estos Términos sin nuestro consentimiento; nosotros podemos cederlos como parte de una fusión, adquisición o venta de activos. Ninguna de las partes es responsable de retrasos causados por hechos fuera de su control razonable.
